THE ONLINE CONTRACT
An online contract of sale means a distance contract for goods and/or services concluded between a supplier (M.D.W. srl) and a customer (natural person holding a VAT number or company) within a distance selling system organized by the supplier to be used via the internet.
ONLINE ORDER FULFILLMENT
Orders placed on the site are processed, unless otherwise agreed, in the shortest possible time; generally within 5* working days from order confirmation for goods available in stock. If one or more products ordered are not available because they are temporarily out of stock or have been discontinued, it is MDW's right to replace the aforementioned products with equivalent or superior items, if replacement with similar products is not possible, a similar article will be proposed by written communication. It is the right of MDW to process an order partially if one or more ordered codes have been discontinued or otherwise unavailable.
STANDARD AND PROJECT-BASED PRODUCTION
*Exceptions to the above times are goods to be produced, in part or in full; to be assembled, in part or completely; to be processed on customer specifications; to import. The work on drawing or project are managed with a written offer in which the processing times are indicated.

M.D.W. S.r.l. (hereinafter MDW) is the subject Supplier of the products and services Object of the Online Contract.
PAYMENT METHODS
For greater clarity, the selling prices of the products displayed are generally indicated both net and inclusive of VAT and any other tax. Except in cases where otherwise specified, the shipment must be considered charged to the customer, the amount of the shipment (function of weight, volume, value of the goods, destination, payment method and carrier) has been unified for simplicity and will be clearly displayed before the completion of the order.
The purchase contract is finalized through the exact compilation and consent to the conditions, expressed through the "online" adhesion, at the end of the procedure an email will be sent confirming the successful completion of the order. The ordered goods travel, unless otherwise indicated by the Customer, with a transport document DDT in which the goods and quantities are indicated but not the prices.
PAYMENT METHODS ALLOWED
Bank Transfer in advance
In case of payment by bank transfer in advance, what was ordered by the Customer can be kept busy, at the discretion of the sales office, until registration of payment.
This payment must be received within 5 working days from the date of acceptance of the order. After this deadline the order is considered automatically canceled.
Credit card, prepaid credit card, PayPal
These transactions are managed through the PAY PAL circuit, the credit cards accepted are all those that rely on the Visa and Mastercard circuits.
MDW is not able to know in any way, in whole or in part, the buyer's credit card information.
All information concerning the Credit Card is managed at the highest levels of security directly within the site that manages the PAYPAL transaction.
In no archive owned by MDW are contained, stored or processed data relating to Credit Cards, Pre-Paid Cards or other cards. For these reasons, MDW cannot be held responsible under any circumstances for any fraudulent and improper use of credit cards by third parties.
The cancellation of an order is possible up to one day before the shipment of the goods, except in the case of custom products or made expressly for the Customer.
The shipment of items in stock takes place on average within 5 days of ordering, unless otherwise indicated.
After shipment, the actual delivery time to the customer depends on the chosen courier and the destination.
The cost of shipping is a function of weight, volume, destination, payment method and carrier.
It is always possible to know the exact cost of shipping before finalizing the order simply by placing the products in the cart.
The shipping cost also includes packaging and INSURANCE which is valid only for goods "ACCEPTED WITH RESERVE".
In all cases where the goods arrive at their destination with packages not in perfect condition, the goods must be accepted with reserve, this wording will be affixed to the receipt that the courier asks to sign by adding a
DETAILED DESCRIPTION OF VISIBLE AND/OR DETECTABLE ANOMALIES
(dents, marks, abnormal noises moving the packaging). In case of unreserved acceptance, the right to refer to the courier's insurance automatically lapses.
It is also possible, for each order, to request delivery carriage forward, in which case it will be necessary to indicate in the order the courier and the subscription number.
Delivery is intended at the house number of the address indicated when ordering, no courier makes deliveries to the floor.
All products sold on the site are covered by a warranty by our company. This warranty is by law 12 months for all users.

It is possible to CANCEL AN ORDER placed on the site subrack.eu by giving TIMELY NOTICE in response to the order confirmation email.
THE CANCELLATION TAKES EFFECT ONLY IF THE GOODS HAVE NOT YET BEEN SHIPPED otherwise the Customer must exercise the right of withdrawal governed by law as described in the next paragraph.
THE CANCELLATION TAKES EFFECT AFTER RECEIPT OF THE CANCELLATION CONFIRMATION EMAIL, mail to be kept as proof of the actual cancellation.
In case of canceled order, the Customer is entitled to a TOTAL REFUND OF ANY AMOUNT PAID.
If the Customer refuses to accept a shipment of an order not canceled or canceled out of time, he will be charged the costs incurred by MDW for sending and returning the package itself.
For all orders placed on the site, the IP number of origin is recorded in order to uniquely and incontestably identify the computer of origin.
Purchases on the subrack.eu website are subject to the discipline of Legislative Decree 206/05, dictated on distance contracts, in cases where the delivery of the goods takes place at the buyer's home, as these purchases are completed outside the business premises.
The Community legislation more commonly known as "Right of Withdrawal" provides that this right can be exercised only by natural persons (consumers) acting for purposes that can be considered unrelated to their commercial activity. The right of withdrawal, therefore, can not be exercised by legal persons and natural persons acting for purposes related to a commercial activity. Purchases made by retailers or by persons who for any reason purchase for resale to third parties are also excluded from the right of withdrawal.
What it consists of: the consumer has the right to withdraw from the contract within 10 working days of receipt of the goods, returning the goods subject to withdrawal to the seller, who will refund the price of the returned goods. It should be noted that in the case of premium operations (the so-called promotions), in which the purchase of an asset is combined with another good that is sold at a ridiculous price or even given away, the right of withdrawal will be legitimately exercised with the return of both goods subject to purchase, given the constraint of the accessory nature of the good in promotion compared to the first.
The right of withdrawal does not apply to audiovisual products or computer software delivered sealed, which have been opened by the consumer. The right of withdrawal is not allowed on the software if the customer has registered it in his name.
To exercise this right it is necessary to have the following documents and data:
• original invoice (indicates the order, invoice, customer number)
• in case of partial withdrawal, in addition to the purchase invoice, the article code (s) of the products
• bank details on which to obtain the transfer (Code CIN - ABI - CAB - Current account consisting of 12 alphanumeric characters of the invoice holder)
The procedure is as follows: the communication must be sent by registered letter with return receipt within 10 working days from receipt of goods. This communication can also be anticipated by email as long as it is confirmed by registered letter with return receipt within 48 hours. The registered letter should be addressed to:

The registered letter must contain the declaration of intention to exercise the right of withdrawal, indicating all the data mentioned above (order number, invoice and customer code, article code of the products to be subject to withdrawal, bank details).
How to make the return shipment: after activating the withdrawal procedure it is necessary to insert the original packaging containing the goods in a special packaging, so as to safeguard the original packaging of the products from any damage, writing or alteration. MDW reserves the right to refuse the goods received in the event of failure to comply with the procedure indicated above. The goods must be shipped at your own expense within a maximum time of 20 days from receipt to the following address:

In the shortest possible time and in any case within 30 days of receipt of the notice of withdrawal, the Consumer will be credited with the sums paid. The only costs charged to the Customer are those related to the return of the product.
BASIC REQUIREMENTS FOR WITHDRAWAL:
The products subject to withdrawal must arrive at our warehouses by courier in special protective packaging and complete with box and accessories in perfect condition (they must be returned in the same condition in which they were sold, they must be SOLD AS NEW).
Products whose packaging, accessories, or the product itself shows signs of wear (including scratches, writing, label marks on the packaging) will be refused and returned to the customer at his expense.
Shipments of components or products that do not contain original packaging, accessories and manuals, which have been made without having requested authorization to return or made without following the sending methods indicated by Customer Service, will not be considered valid for the purpose of the Right of Withdrawal. In such cases, the transport costs related to the return will be charged to the customer.
The product replacement procedure for incorrect shipment can be activated when a product other than the one the customer ordered has been mistakenly shipped and, therefore, not present in his order. The procedure can be activated within 8 calendar days from the date of delivery of the goods.

Before activating this service it is advisable to compare what has arrived with the technical description of the article on the site, where you can view a detailed photo of each item and its main technical characteristics.
Shipping costs are charged to MDW and the shipment must be made by the courier indicated by Customer Service.
The item must be returned in the state in which it was delivered, therefore without signs and writings of any kind on the package and without having been opened or used in any way. We recommend to use a rigid box and special packaging that protects the item from damage during transport. The opening of the package will be allowed, as indispensable, only in the event that the packaging does not allow the verification of the ordered product with respect to the one delivered.
In the event that the item on the purchase invoice is no longer available, Customer Service will issue a Credit Note or bank transfer to the customer's current account. The amount of any credit note or bank transfer will be calculated taking into account any discounts and promotions on the purchase invoice.
The Dead On Arrival (DOA) procedure requires that goods are returned using a rigid box containing the original packaging. The latter must be absolutely free of any writing or tear, complete with all the accompanying material and internal protections to preserve its good condition during transport.
This service can be activated within 8 days of receipt of the goods and if the same is not complete with all its parts or accessories supplied.
Before activating this service it is advisable to compare what has been delivered with the technical description of the article, as well as the accompanying material described on the site.
The activation of the service can be done by contacting Customer Service.
In the event that the courier makes the delivery with visibly damaged packaging, it is advisable to accept the goods "with reserve" by affixing on the transport document the reason "Goods with visibly damaged packaging".
The Customer must then contact, no later than 8 days, the Customer Service who will open a damage practice for the replacement of the goods. The same procedure must be activated in the manner indicated above even in the event of damage to the product.
